L’Oréal Faces MDL Lawsuits Over Contaminated Benzoyl Peroxide Products


L’Oréal faces six class action lawsuits that have been filed against CeraVe and L’Oréal involving allegations that benzoyl peroxide acne treatments contained high levels of benzene, a cancer-causing chemical. 
 
The U.S. Judicial Panel on Multidistrict Litigation (JPML) will decide later this month whether or not to consolidate and centralize the CeraVe lawsuits and similar filed claims after hearing oral arguments. 
 
A previous JPML tried to consolidate similar claims in August 2024 but was rejected because of the diversity of the products and manufacturers. A revised motion seeks to consolidate claims against L’Oréal in the District of Hawaii. 
 
The plaintiffs claim that there were high levels of benzene in CeraVe and other benzoyl peroxide treatments that exceeded federal safety standards. 
 
The lawsuits follow a report that was released in March 2024 by Valisure, an independent testing lab, which identified benzene contamination in various acne treatments, including CeraVe, ProActive, and Clinique.
